The Law Society of Hong Kong has noted various press reports on recent comments in a public forum made by Ms Leung Oi Sie Elsie, currently the Deputy Director of the Basic Law Committee of the HKSAR of the Standing Committee of the National People’s Congress of PRC (“NPCSC”).
香港律師會留意到,近日就全國人大常委會香港基本法委員會副主任梁愛詩女士日前出席一個公開論壇時作出的言論的報導。

The Law Society of Hong Kong does not have a full transcript of Ms Leung’s comments and therefore is not in a position to fully respond to these comments. However, the Law Society of Hong Kong notes that under the Basic Law, Hong Kong courts are authorized by the NPCSC to interpret on their own, in adjudicating cases, the provisions of the Basic Law which are within the limits of autonomy of Hong Kong.
香港律師會並沒有梁女士的講話內容的詳細記錄,故難以全面作出回應。不過,香港律師會注意到,根據《基本法》,全國人大常務委員會(人大常委會)授權香港的法院在審理案件時對《基本法》關於香港特區自治範圍內的條款自行解釋。

The Law Society of Hong Kong believes that the independence of the judiciary in Hong Kong is deeply established, and the quality, integrity and credibility of our judges are well respected.
香港律師會認為,香港的司法獨立已被清楚確立,而香港法官的質素、品格及威望,一直都受到尊重。

Given the expressed concerns raised by the community over the effects of an interpretation of the Basic Law by the NPCSC on the independence of the judiciary and the rule of law as Hong Kong’s core values, the Law Society of Hong Kong believes the Government should act cautiously when considering whether to seek an interpretation of any provisions of the Basic Law.
基於社會曾經對由人大常委會對《基本法》的解釋對司法獨立及法治的影響,而法治亦是香港的核心價值之一,香港律師會認為,政府在考慮是否就《基本法》的條文作出解釋時,應該謹慎行事。

On the question of Mainland mothers giving births in Hong Kong, given established legal principles, the Law Society of Hong Kong considers that a referral to the NPCSC to interpret Article 24(2)(1) of the Basic Law will undermine the authority and standing of the Court of Final Appeal and likely damage the rule of law in Hong Kong.
至於「雙非」的問題,根據已確立的法律原則,香港律師會認為,向人大常委會尋求對《基本法》第24(2)(1)條作出解釋,將會削弱終審法院的地位和權威,並損害香港的法治。

背景 Background
是次研討會是籌備校長中心專責小組(專責小組)與教育局第五次合辦有關籌備成立校長中心的活動。
專責小組特意邀請香港律師會會長王桂壎先生以及恒生銀行執行董事兼個人銀行業務主管梁永祥先生擔任講者,他們將會與各位分享有關「邁向專業社群」的經驗。
此外,專責小組的數位成員於本年二月出訪加拿大多倫多,目的是汲取當地一些校長組織的經驗,以籌備成立香港的校長中心。專責小組將會透過這研討會,與各校長分享加拿大之行的啟示,以及跟進「專責小組」的工作進展。
This seminar is the fifth activity co-organised by the TFPI and the Education Bureau on the setting up of a Principals’ Institute (PI) in Hong Kong.
Mr WONG Huen, President of The Law Society of Hong Kong and Mr LEUNG Wing-cheung, William, Executive Director and Head of Personal Banking of Hang Seng Bank, have been invited to be guest speakers to share their experience on “Becoming a Professional Community”.
Several TFPI members visited Toronto, Canada in February 2011 to gather views and experience from various principals’ associations for the establishment of a Principals’ Institute (PI) in Hong Kong. The TFPI would like to take this opportunity to share learning inspired by the visit to Canada and update the progress of TFPI.

EDB - 籌備校長中心專責小組 Task Force on Setting up a Principals’ Institute (TFPI)
為配合《校長持續專業發展諮詢文件》(二零零二年二月) 所載的建議,教育局在二零一零年年初成立籌備校長中心專責小組 (專責小組)。
專責小組負責透過更廣泛的諮詢及整合工作,敲定成立校長中心的細節安排,以及就不同的校長領導才能範疇制定專業指引。
此外,專責小組將與校長專業發展導向委員會緊密合作,共同為未來的校長中心以及在職校長持續專業發展的理念架構制定藍圖。
In line with one of the recommendations in the Consultation Paper on Continuing Professional Development (CPD) of Principals (February 2002), the Education Bureau established the Task Force on Setting Up a Principals’ Institute” (TFPI) in early 2010.
The TFPI was entrusted with finalizing the details of the Principals’ Institute (PI) establishment as well as developing professional guidelines on different domains of principals’ leadership through wider consultation and consolidation.
It would liaise closely with the Steering Committee on Principals’ Professional Development in formulating the blueprint for the future PI and the CPD framework for serving principals.
